Terms of Service

1. Acceptance of Terms

By accessing or using the NextEVI platform, website (nextevi.com), APIs, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree with any part of these Terms, you must not access or use the Service.

2. Description of Service

NextEVI is an AI-powered voice interview platform designed to conduct interviews with both customers and employees at scale. The Service includes, but is not limited to:

  • AI-conducted voice interviews with customers, employees, users, and other participants
  • Real-time recording, transcription, and analysis of voice conversations
  • Automated synthesis of interview data into actionable insights, themes, and reports
  • Dashboard access for reviewing transcripts, emotional signals, and aggregated findings
  • Integration capabilities with third-party tools and enterprise systems

NextEVI’s AI interviewer adapts to participant responses in real time, employing emotional intelligence and adaptive follow-up questioning to surface insights that traditional surveys, forms, and static research methods miss.

3. User Accounts and Registration

To access the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

  • Provide truthful and up-to-date registration information
  • Notify NextEVI immediately of any unauthorized access to your account
  • Not share your account credentials with unauthorized individuals
  • Ensure all users within your organization comply with these Terms

NextEVI reserves the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where practicable.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Conduct interviews that are deceptive, coercive, or designed to manipulate participants
  • Collect information from minors without verifiable parental consent
  • Interview participants without their informed consent regarding the AI-driven nature of the conversation
  • Violate any applicable local, state, national, or international law or regulation
  • Attempt to reverse-engineer, decompile, or extract the underlying models, algorithms, or source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use interview data to discriminate against individuals based on protected characteristics
  • Resell, sublicense, or redistribute the Service without written authorization from NextEVI
  • Misuse the WhatsApp communication channel, including sending spam, unsolicited messages, or using it for purposes other than those intended by the Service

5. WhatsApp Communications

By using the Service and providing your phone number, you acknowledge and agree that:

  • You consent to receive transactional messages via WhatsApp, including voice interview invitations, scheduling confirmations, interview result notifications, and account updates
  • You consent to receive platform-related messages via WhatsApp, including research participation reminders, insight reports, onboarding guidance, and service announcements
  • WhatsApp messages are delivered through Meta’s WhatsApp Business Platform, and your use of WhatsApp is also subject to WhatsApp’s own Terms of Service
  • Message frequency may vary based on your interview activity, research participation, and engagement with the platform

You may opt out of receiving WhatsApp messages at any time by replying “STOP” to any WhatsApp message from NextEVI, or by contacting us at hello@nextevi.com. Opting out of WhatsApp communications will not affect your access to the core features of the Service.

6. User Responsibilities

When using the Service, you agree to:

  • Provide accurate and up-to-date contact details, including your phone number and email address, to ensure smooth interview coordination and platform communication
  • Not misuse the WhatsApp channel for any purpose outside the scope of the Service, including sending unsolicited messages or content unrelated to your voice interviews and research
  • Ensure that any participant phone numbers you provide to the platform belong to individuals who have consented to participate in AI-conducted voice interviews and receive related communications from NextEVI
  • Promptly update your contact information if it changes to avoid disruption to interview scheduling and results delivery
  • Comply with all applicable laws regarding electronic communications, voice recording consent, and data privacy

7. Intellectual Property

Your Data: You retain full ownership of all data you submit to or collect through the Service, including interview recordings, transcripts, participant responses, and any derived insights generated from your data (“Your Data”). NextEVI does not claim ownership of Your Data.

Our Platform: The Service, including its AI models, algorithms, software, user interface, branding, documentation, and all associated intellectual property, is and remains the exclusive property of NextEVI. These Terms do not grant you any rights to NextEVI’s intellectual property except the limited right to use the Service as described herein.

Aggregated Data: NextEVI may use anonymized, aggregated, and de-identified data to improve the Service, train AI models, and conduct research. This aggregated data will not identify you, your organization, or any individual interview participant.

8. Data Collection and Processing

The core functionality of NextEVI involves collecting and processing voice data. By using the Service, you acknowledge and consent to the collection and processing of:

  • Voice recordings: audio captured during AI-conducted interviews
  • Transcripts: text-based transcriptions of voice conversations generated in real time
  • Emotional and tonal analysis: AI-derived signals including sentiment, emotional cues, and conversational tone
  • Synthesized insights: themes, summaries, and actionable findings produced by our analysis engine
  • Metadata: interview duration, timestamps, language, and technical session data

You are responsible for ensuring that all interview participants are informed about and consent to the recording and AI-based analysis of their conversations, in compliance with applicable data protection and wiretapping laws.

9. Confidentiality of Interview Data

NextEVI treats all interview data as confidential. We implement enterprise-grade security measures, including end-to-end encryption for data in transit and at rest, to protect the confidentiality and integrity of voice recordings, transcripts, and analysis results.

For organizations in regulated industries (including healthcare, financial services, and government), NextEVI offers on-premise deployment options where all voice data and processing remain within your own infrastructure, ensuring compliance with sector-specific data residency and security requirements.

NextEVI personnel will not access your interview data except as necessary to provide support you have requested, resolve technical issues, or comply with legal obligations. Access is logged and auditable.

10. Service Availability and SLA

NextEVI strives to maintain high availability of the Service. We target 99.9% uptime for our cloud-hosted platform, excluding scheduled maintenance windows communicated in advance.

Enterprise customers may be eligible for a separate Service Level Agreement (SLA) with defined uptime commitments, response times, and remedies. Contact hello@nextevi.com for enterprise SLA details.

NextEVI does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, NextEVI and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

NextEVI’s total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to NextEVI during the twelve (12) months preceding the event giving rise to the claim.

You acknowledge that AI-generated interview analysis, insights, and recommendations are provided as decision-support tools and should not be treated as definitive conclusions. NextEVI does not guarantee the accuracy, completeness, or reliability of AI-generated outputs.

NextEVI shall not be liable for any issues arising from the WhatsApp platform or other third-party communication services, including but not limited to message delivery failures, platform outages, data breaches on third-party platforms, unauthorized access to messages by third parties, or changes to third-party platform policies. Your use of WhatsApp is subject to Meta’s terms and policies, and NextEVI disclaims all liability for Meta’s handling of your data or any actions taken by Meta in relation to the WhatsApp platform.

12. Opt-Out and Grievance Redressal

Opting out of communications: You may opt out of receiving WhatsApp or other electronic communications from NextEVI at any time by:

  • Replying “STOP” to any WhatsApp message from NextEVI
  • Emailing your opt-out request to hello@nextevi.com
  • Managing your preferences in your NextEVI account settings

Grievance redressal: If you have any complaints, concerns, or grievances regarding the Service, our communications, or the handling of your data, you may raise them by contacting us at hello@nextevi.com. We are committed to addressing all complaints promptly and will acknowledge your grievance within 48 hours and aim to resolve it within 30 days of receipt.

13. Termination

You may terminate your account at any time by contacting us at hello@nextevi.com or through the account settings in the Service.

NextEVI may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms or engage in activity that could harm the Service, other users, or interview participants.

Upon termination, you may request an export of Your Data within thirty (30) days. After this period, NextEVI will delete Your Data from our systems in accordance with our data retention policies, unless retention is required by law.

14. Changes to Terms

NextEVI reserves the right to update or modify these Terms at any time. We will notify you of material changes by posting a notice on the Service, sending an email to the address associated with your account, or via WhatsApp message (if you have opted into WhatsApp communications) at least thirty (30) days before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and terminate your account.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.
